How to solve the deepfake problem? ›

The simplest resolution would be for Congress to enact a federal statute preventing creators of deepfake content from using another person's image, likeness, and/or voice without their consent. This law could be modeled after state law right of publicity statutes.

For images and video files, deepfakes can still often be identified by closely examining participants' facial expressions and body movements. In many cases, there are inconsistencies within a person's human likeness that AI cannot overcome.

1. Face-swapping deepfakes: This is the most common form, where the face of one person is superimposed onto another's using deep learning algorithms. It can be done convincingly, making it appear as if the target person is saying or doing things they haven't.

Researchers are developing new ways to detect deepfakes, such as AI models that spot color abnormalities. And authentication methods, like digital watermarks, can help prove that a video or image has been altered. But simply detecting deepfakes may not be enough to prevent harm.

Watching deepfakes is not illegal in itself, except in cases where the content involves unlawful material, such as child pornography. Existing legislation primarily targets the creation and distribution of deepfakes, especially when these actions involve non-consensual pornography.

The Disrupt Explicit Forged Images and Non-Consensual Edits, or DEFIANCE Act, allows victims to sue if those who created the deepfakes knew, or “recklessly disregarded” that the victim did not consent to its making.

Because artificial intelligence is piecing together its creations from the original work of others, it can show some inconsistencies close up. When you examine an image for signs of AI, zoom in as much as possible on every part of it. Stray pixels, odd outlines, and misplaced shapes will be easier to see this way.
